Dear UKCC,

Important News regarding Tier 4 Student Visas

1.   A judge in the High Court in London has ruled that the UKBA was wrong to introduce the rule that students require CEFR Level B1/B2 as a minimum level of English to apply for a General Student Visa (GSV).  The judge said that this rule should have been passed by parliament before it was introduced.  This was decided in a Judicial Review brought by English UK against the Home Secretary, which was heard on 29 and 30 June 2010.

2.   This result means that the law will now revert to the situation that existed before 3 March 2010, so students with CEFR Level A1 (elementary level) can now once more apply for a GSV to enrol for an English language course at CEFR Level A2.  Students wishing to study English language will no longer need to be at CEFR Level B1.

3.   For BBSI certificate, higher-certificate, diploma, foundation and pre-masters courses,
we will of course still need proof that that the student is at the required level to undertake their chosen course by making language level checks, eg recent certificates, BBSI on-line test, Skype interview etc.

4.   We understand that the Home Secretary will not appeal the decision, so you are free to enrol students at elementary level and above for English language courses at BBSI from next week.  Please see the attached Press Release for more details.

Dear Partners

We are delighted to announce that the UK EFL industry has today won the case for lowering the English language requirement for TIER 4 students.

As you know, on March 3rd 2010 the English language requirement for students applying for General Student Visas was raised to B1. Today, it was announced that the language requirement will revert back to A2. We expect to be able to apply this new regulation from the 12th July 2010.
