현재의 검찰은 일제강점기때 설계된 기형아: 구조적인 개혁을 해야한다.
1. 행정권력(수사권)과 사법권력(기소독점권/기소편의주의)을 동시에 보유ㅡ 헌법정신에 위배되는 체제: 역사적으로 잘못된 뿌리:
사법권력으로서의 삼권분립의 정신을 구현하려면 국민주권이 개입되도록 하여야
1)검사장을 국민이 직접 선출: 미국처럼 검사장에 지방검사인사권 부여
ㅡ검찰청법 개정으로 가능함
2)검찰청을 해체하고 기소청을 두되 기소청장은 대통령이 국회동의를 얻어 임명하고, 임기제의 기소위원은 기소청장이 국회동의를 얻어 임명
ㅡ기소청법 입법으로 가능함
ㅡ수사권은 자동으로 분리
2. 일단 서울대 한인섭교수의 지적처럼 전관예우의 철폐가 필요: 한교수 표현처럼 전현관특혜비리의의 철폐가 절대적으로 요구되고,
판검사들의 변호사 개업시 유예기간을 두어서 전현직 판검사들의 인적 연결고리의 격리가 필요.
ㅡ변호사법 개정으로 가능함

Indictment members are appointed by the head of the Indictment Office with the consent of the National Assembly.
- It's possible through the legislation of the Indictment Office Act.
- The right to investigate is automatically separated.
2. As pointed out by Professor Han In-seop of Seoul National University, it is necessary to abolish all the privileges of former posts.
: As Professor Han expressed, predecessor privileges must be abolished. In addition, it is necessary to isolate the personal links of current and former judges & prosecutors by providing a grace period when they open law firm.
