선박의 소유 및 운항에 따라 선주 또는 용선자에게 발생하는 손해 및 배상책임은 다양하기 때문에 일반의 선박보험만으로는 모두 커버할 수 없다. 예를 들면 선박 이외의 화물에 대한 충돌손해배상책임·난파선 제거비용·선원의 사상에 대한 배상책임 및 비용·선하증권의 면책조항에 해당되지 않는 배상책임 등은 모두 선박보험의 대상이 되지 못한다. 이처럼 선박의 소유와 운항에 관련, 제 3자에 대한 법적 배상책임을 보전하는 선주 상호간의 보험을 P & I 보험이라 하고 이의 조합을 P & I Club 이라 부른다.
선주의 제 3자에 대한 배상책임을 담보하는 일종의 선주 상호간 공제조합으로 비영리단체라는 점이 그 특징이라 하겠다. P & I Club에서 담보하여 주는 선주의 책임은 국가별로, 또는 특정클럽에 따라서 다소간 다르긴 하지만 어느 경우든지 선원의 사상이나 제 3자에 대한 선주의 법적배상 책임이 주요한 담보대상이 되고 있다.

입항국의 감독관이 외국선박에 대해 행사할 수 있는 감독권은 STCW 조약에 의해 선원의 유효한 증명서 휴대여부에 대한 확인 및 해난시 당해선박 선원의 직책을 유지할 능력을 보유하고 있는지에 대한 확인으로 한정되어 있고 이 경우에 있어서 선박의 항해금지 조치를 취할 수 있는 것은 요건의 미비가 시정되어 있지 않고 또한 당해요건의 미비로 인해 인명, 재산 또는 환경에 휘험이 있다고 판단되는 경우로 한정됨.
나아가 동 STCW 조약에 기초 감독을 할 때는 선박을 부당하게 억류하거나 선박의 출항을 부당히 지연시키는 일이 없도록 모든 가능한 노력을 기울여야만 한다고 명시되어 있음. "
